We like many of you found a great community in which to live. We purchased our home and waited for over a year, traveling daily to see the progress of our new home during the construction period. Rolling hills and quietness of which one only dreams. Yes, we knew of the CC&R's, Bylaws and the Design Review Guidelines. We read through the documents and like many felt tentative regarding the HOA, but loved the area and the homes. We felt that as long as the HOA management company and board were logical in their approach to the needs of the new community and followed the law everything would be just fine. We were one of the first to close escrow in the community and got right to work planning and working on our property. Soon, we realized the HOA was not what we had hoped for in any way, shape or form. We had purchased a lot in HOA hell. We have learned a great deal and we intend to share our stories and findings with you. We hope you will find the show refreshing, supportive and interesting. Small Claims Court Case of Illegal Lien | The nine-page small claims suit prepared by the homeowner is extremely detailed. The homeowner lays out the California Civil Code sections that must be complied with when an association and/or debt collector want to record a Notice of Default against a home. The suit alleges that, among many other causes of action, Angius & Terry recorded the Notice of Default without the consent of the association board.
Small claims court agreed with her claims: it awarded her $7900 plus court costs. Angius & Terry has appealed the decision.
The appeal was to have been heard on June 16, but the Contra Costa superior court judge recused himself from the case saying that he has had prior business dealings with Angius & Terry. A new court date of August 4 has now been set; the new trial will be before a different judge.
